By accessing or using our website, www.thatkidthing.com.au ("this site"), or by booking our programs and services, you agree to be bound by these Terms and Conditions ("Terms"). If you have any questions, please don’t hesitate to contact us.

These Terms form part of, and are subject to, our Privacy Policy, which is available on our website.

1. Agreement to these Terms and Conditions

By using this site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue using this site immediately.

2. User Registration

To access and book services through this site, you may be required to create an account. By registering, you agree to the following:

  • You may only register one user account per person. The creation of duplicate or multiple accounts for the same user is strictly prohibited.

  • That Kid Thing reserves the right to cancel or terminate any duplicate or multiple accounts registered by the same user without notice.

  • You are responsible for maintaining the security of your password and login credentials. That Kid Thing will not be liable for any loss or damage resulting from the misuse of your account.

  • You must notify us immediately if you suspect any unauthorised use of your account.

  • To register an account, you must provide:

  • A valid email address.

  • Accurate billing and contact information, including your street address and authorised billing contact details.

  • All information provided during registration must be accurate and up to date.

Approval of Registrations: We reserve the right to accept or reject any application for registration at our discretion.

3. Orders and Subscriptions

Order Process:

  • By placing an order through this site, you make an irrevocable offer to purchase the products/services you have selected, subject to these Terms.

  • We reserve the right to accept or reject any order at our discretion.

  • Your order is confirmed when payment has been processed, and you receive a confirmation email from That Kid Thing.

Subscriptions:

  • We offer subscription services for periods of 3, 6, or 12 months, which will automatically auto-renew at the end of each subscription term.

  • Subscription payments are made monthly.

  • Subscriptions cannot currently be cancelled during the active subscription period.

Rescheduling & Cancellations:

  • Brushes & Bites, STEAM Lab, and Crafting with Baraqah classes can be rescheduled provided that cancellations are made at least 24 hours before the class.

  • Rescheduled bookings must be made within 30 days of the original booking date.

  • Junior STEAM Masterclass sessions cannot be rescheduled due to the sequential nature of the program.

  • Bookings are non-transferable to other students, except in extenuating circumstances, at the discretion of That Kid Thing.

  • No refunds will be offered for gift cards or missed sessions unless required by Australian Consumer Law.

4. Payments

  • Payments are processed securely via third-party payment providers, including (but not limited to) Stripe and PayPal. That Kid Thing does not store your credit card information.

  • Orders will not be processed until full payment is received.

  • If your payment cannot be processed, your order will be cancelled.

Refunds: No refunds are available for our programs unless required by Australian Consumer Law. Please refer to our Statutory Rights section below for more information.

5. Shipping Policy

Shipping Methods: Art packs and other physical products purchased through That Kid Thing will be shipped via Australia Post or by courier.

  • Shipping Costs: Calculated based on the delivery location and the size/weight of the items purchased. Shipping costs are displayed during checkout.

  • Delivery Time: Estimated delivery times vary between 3-10 business days, depending on your location. Delays may occur due to external factors.

  • Lost or Damaged Items: That Kid Thing is not responsible for items lost or damaged during shipping but will work with customers to resolve issues.

6. Intellectual Property

Proprietary Content: All content on this site, including text, graphics, designs, software, data, and other materials ("Proprietary Content"), is the property of That Kid Thing or its licensors. You are not permitted to reproduce, distribute, modify, or create derivative works from any Proprietary Content without our prior written consent.

Trademarks: The That Kid Thing name and logo, as well as the program names "Brushes & Bites," "Junior STEAM Masterclass," "STEAM Lab," and "Crafting with Baraqah," are trademarks of That Kid Thing Pty Ltd. These trademarks may not be used in connection with any products or services without our express written permission.

7. Prohibited Conduct

When using this site, you agree to the following prohibited conduct rules:

  • Do not use any device, software, or routine to interfere or attempt to interfere with the proper functioning of this site.

  • Do not engage in any action that places an unreasonable load on our infrastructure.

  • Do not use this site to transmit or store any illegal, harmful, obscene, or offensive material.

  • Do not use this site to violate any laws or engage in any fraudulent activities.

  • Do not reverse engineer, decompile, or otherwise modify any part of this site without our written consent.

That Kid Thing reserves the right to terminate your account or access to this site if you engage in any prohibited conduct.

8. Statutory Rights (in compliance with Australian Consumer Law)

Nothing in these Terms affects your statutory rights under the Australian Consumer Law. Under Australian Consumer Law, you are entitled to certain guarantees that cannot be excluded, including guarantees relating to the quality of goods and services.

For products or services that fail to meet the guarantees under the Australian Consumer Law, you may be entitled to:

  • Repair, replacement, or refund for faulty goods.

  • Repeat performance or compensation if the services fail to meet acceptable quality.

These remedies apply to eligible goods and services under the ACL and do not affect our no-refund policy for change of mind or missed classes as outlined in our Payments and Refunds section.

9. Limitation of Liability

To the maximum extent permitted by law, That Kid Thing and its officers, employees, and agents exclude all liability for any loss, cost, expense, or damage arising from your use of this site or services, except where required by law. We are not liable for indirect or consequential losses.

Force Majeure: That Kid Thing will not be liable for any delay in performance due to circumstances beyond our control, including but not limited to natural disasters, strikes, or technology failures.

10. Indemnity

You agree to indemnify and hold That Kid Thing, its officers, employees, agents, consultants, and affiliates harmless from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:

  • Your use of the site.

  • Your violation of these Terms.

  • Your violation of any third-party rights, including intellectual property rights.

11. Third-Party Services

This site may use third-party services, such as payment processors, analytics, or booking platforms. That Kid Thing is not responsible for the privacy or security practices of these third parties.

We do not control or endorse any third-party content linked from this site.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you agree to submit to the jurisdiction of the courts of NSW. If you are using our services from other states in Australia, these Terms will still apply.

13. Changes to These Terms

We reserve the right to amend these Terms at any time. Your continued use of the site will be deemed acceptance of any updated Terms.
